A grand jury indictment is a lot of nothing. It comes from a proceeding, held behind closed doors, where one side puts forth their evidence with no cross examination of witnesses, no rebuttal presentation and no evidence to the contrary. In 32 years in our legal system, I participated in many grand juries. In all that time, not once did a grand jury fail to return an indictment. As the expression goes, “a grand jury would indict a ham sandwich.” But it does get all kinds of headlines and leaves people like Emery, clutching pearls while lying on the fainting couch enjoying some kind orgasmic euphoria.
Let’s see what happens after legal examination of evidence and witnesses. If there is a conviction in a court of law, then Emery can get excited.
