Tonight the FBI raided former President Trump’s Florida residence unannounced.  This is an historical  and unprecedented action which has horrible portents for our republic.  I’ll have more to say about this, and so will RR readers who need a place to record their sentiments as this story develops over the next days.  If there is no smoking gun produced by the DoJ in this case, then we have definitely transitioned into a political thugocracy.

    Was this the response you referred to concerning public access to the declassified files?
    T”he FOIA issue concerning access to formerly classified, now sub-rosa presidentially declassified federal documents, is a valid concern, and a good point to discuss. We can all think of reasons why some such documents, subsequently released through FOIA, would not serve the national interest. My own recommendation of using a more formal procedure for presidential declassification was offered to avoid the current problems of sub-rosa disposition of classified documents.”

    Well thats succinct –
    This was an unprecedented, unnecessary, unlawful home raid on a former president. The whole legal basis for the raid has been blown apart. They went after Trump, they say he may have violated the Espionage Act. That’s not even possible as the commander in chief he can declassify anything he wants. They say he may have stolen or misused government property under the Presidential Records Act and other statutes.
    That’s just not possible. There’s a 2012 decision by an Obama judge that former presidents can take personal records with them when they leave office. So there goes the obstruction allegations. It’s legally impossible to obstruct non-crimes like they’re trying to investigate here. There’s a track record of lying in this case. They leaked out that Attorney General Merrick Garland did not personally approve this raid. That’s a lie. They leaked out that Trump had nuclear documents at Mar-a-Lago. That’s a lie. They leaked out that president Biden and the Biden White House was not — did not have a heads-up about this raid. That’s a lie.

    The FBI did not raid Mar-a-Lago to get classified documents. They raided Mar-a-Largo to get unclassified Crossfire Hurricane documents back and deep six them forever.

    It is a long read and not for the faint of heart, but it’s a pretty solid argument. I wouldn’t be surprised if the magistrate appointed special master. DOJ is behaving very inappropriately leaking to the media and putting unrelated information into pleadings. It is a bad look and won’t be taken kindly to by the magistrate. The behavior is pretty egregious. Airing unrelated dirty laundry in pleadings is not usually a good idea.

    While Judge Cannon’s stay and order to have a untainted special master’s review items seized at Mar-a-Lago for executive privilege and attorney client privilege is being fought tooth and nail by the DOJ and is complicated, I found one section in the article of upmost interest.
    First, the article:

    To which reenforces my belief that the media is characterizing the mid-terms of as a bullshit race between Biden and Trump. Punchy would be exhibit A from the media sources he is spoonful.
