[Well, there you have it.  Former FBI director Comey is a politician for all seasons.  Where else can you find a man who can deliver to both sides of a terminally divided Washington a smorgasbord version of events that can concurrently bring pleasure if not outright glee to both sides of the aisle?  Everyone found much to like in what he said – a tour de force performance by the now ever copasetic, cautiously comportable (yet cowardly?) Comey.  gjr]

    18USC SS641 is a directly relevant statute. Just listened to 3 lawyers discussing other potentially relevant statutes but 18 USC is the one that has been focused on since he admitted a 3rd party transfer yesterday. 😉

    Sharing the “memo” with the PRESS via his friend is more truthful, isn’t it Stevie, and Comey did share that he did that to provoke the naming of a special counsel, thus manipulating the government from the outside looking in. Well played, Mr. Comey.

    18 USC SS641 relayes to THEFT of government property and materials. The record was not an official government document…if it were an official report on a meeting known as a 302 it would be a record. Regardless Comey gave the record to Mueller. According to court interpretation of USC 641 the statute relates to theft of an item of financial value….I guess Comey could have sold his recollection….but he didn’t he gave it away.

    You can ask for anything to be reviewed for FOIA release, if you get what you want is another thing. You can also request a classification review and executive privilege counts as a classification, there are a number of classifications from mundane to eyes only compartmented.
    Either way its an executive branch document that was transferred to a 3rd party with Comey admitting intending it to be transferred to the press. Comey also said clearly he knew he could not hand it off himself. 😉

    It is well played Mr. Comey…and perfectly legal…and he is going to help drive this President into early retirement. I say more power to him. True that politics makes strange bedfellows, but then again, the enemy of my enemy may not be my friend but he can be my ally. Trump is unfit to be President and the faster he is destroyed politically the better off we will be.

    Comey opened himself up to prosecution by ;eaking official government owned classified documents. His conversation was classified and he leaked them. So adios Mr. Comey. Steve Frisch thinks he can be you attorney so good luck. Trump will be there another 7.5 years and America will be saved from the likes of the Frisch and Obama. Thank you President Trump.     Any document generated by a federal employee belongs to the archive of the US and the agency. Your ignorance of the legal standing of notes of an FBI agent is understandable but its time to admit you are as wrong as you were about the fact of a document transfer.
    Comey does not own it, the executive branch owns it, just like all of the docs in presidential libraries. He can not legally give it away.

    The actual wording of the statute:
    “Whoever embezzles, steals, purloins, or knowingly converts to his use or the use of another, or without authority, sells, conveys or disposes of any record, voucher, money, or thing of value of the United States or of any department or agency thereof, or any property made or being made under contract for the United States or any department or agency thereof; or
    Whoever receives, conceals, or retains the same with intent to convert it to his use or gain, knowing it to have been embezzled, stolen, purloined or converted—”
    Comey leaked the memo, to a 3rd party, to leak to the press in order to get a special persecutor involved once Comey couldn’t keep leaking from the inside. No Stevie, not “perfectly legal”.

    Good answer Steve. “I will just wait a month….”. Punchy would never say that. Too impatient. That’s my take as well. Let’s see how it all falls out. Time will tell. Once it goes the Legal Eagles, no telling what happens. A lot of flyballs die out in centerfield.
    Without reading one legal agrument on The Memos, seems to moi that all private conversations with the President and his underlings are classified by its very nature. That’s why you can’t get Obama’s phone conversations with Hillary during her silly private server chapter. Of course, a President can declassify anything he chooses.
    Now, Comey was on the clock when he wrote the Feb. memo. Whether he did it on a gov’t server or took his notes home, it don’t matter. Those memos a property of the US Government, a very large bureaucracy headquartered in Washington DC. Ain’t his, it is property of Uncle Sam. Even notes stays with Uncle Sam. No to be removed. The timeline in question is when our long time public servant was on the clock.
    I seem to recall a certain General and high ranking CIA chief sharing notes he took after conversations he had with top officials. Most of the no-no such as his personal notes a notes are classified and he had not right to share them with his secret squeeze box or anyone. They belonged to Big Bro, period. Sure, he also leaked other “classified documents”, but his notes were Exhibit A. What was his name? Oh yeah.
    On November 7, 2012, Petraeus tendered his resignation as CIA chief to President Obama, per directive from James Clapper.[6]
    On November 9, 2012, Petraeus resigned as Director of the CIA after admitting having a sexual relationship with his biographer.
    On April 23, 2015, Petraeus pleaded guilty to a misdemeanor charge of mishandling classified materials. He was given a two-year probationary period and a fine of $100,000.[7]

    Bill, no conversations with the President are not automatically classified unless they contain classified information–they may be privileged but one would need to claim executive privilege and prove it. The legal standard is not that all government documents are government property–official documents and records are–nor is some one always “on the clock” And did you miss the identification of the materials as “classified” in the Petreus case?
    Finally, do you realize how ridiculous you all look arguing over whether or not the memo was legally released, as opposed being appalled at the content of the memo, that the President of the United States is actively engaged in obstruction of justice, not just based on Comey’s testimony, but based on his own words when he said publicly that Comes was fired to stop the investigation?
    I find it humorous that there are people here that spent a good part of their lives opposing Communism but are happy to have their heads so far up the former USSR’s back side that they can’t see the Constitution through the borscht.

    As far as your critique of Truckee is concerned…besides being somewhat ridiculous…Truckee is a vibrant growing economy and community which is almost solely responsible for population, economic and residential growth in Nevada County…if one removed the Truckee statistics Nevada County would look like Lake County…we are an engine in the County because we get along well with each other and have been able to develop a common vision for the future of our community whereas the influence of your confrontational mindset has stalled progress in the rest of the County.

    Come on Todd, Truckee is a nice place. Haven’t stopped off there in a few years, but it seemed nice on a beautiful summer day. At least what I saw from the freeway. And they had a round-dee-bout before the other side of Donner Party Cookout Mountain did. It’s all good and some thrive on the cold. And thank goodness we are not Lake County….a county that is quite similar to Nevada County in demographics and a thousand points of light.

Trump yesterday showed us a 70 pound stack on paper from a EIR for a road in Maryland. $29,000 a page. 29 million bucks. For a road! Anyway,your ilk does this all the time to extort money. So the houses have to behuge and expensive that even tgose employees of your SBC must llive in hovels.

    This whole Truckee thread is hilarious.
    Truckee is thriving. You know it, the readers here know it, the County knows it, and the numbers prove it. Almost all job and economic growth in the county has occurred in the last 15 years in the eastern County. As I stated earlier the reason for that is clear…we like each other and get along and our political culture is collaborative. I love the western county, and could not agree with you more that you have charming towns and landscapes, interesting people, and real amenities. It really is a shame that you can’t get your stuff together and leverage that for the economic growth and opportunity that it should and could be driving.

We went through this with your view of health care. When i asked you for real examples you responded by saying it is only your opinion and there were none and it didn’t matter because it was just your opinion. .
