Most all of the victories won by ‘the open it up, let me go back to work’ crowd have been won at the State Court level, including the State Supreme Courts. Governors and State employees must follow their constitution.
The DOJ Civil Rights has jumped in to protect religious freedoms and liberties that have violated civil liberties as enshrined in the Bill of Rights during lock downs.
Interesting question. Can a State close down a business that provides goods and services to folks in other states, thus affecting the economic activity of those other states? The Commerce Clause prohibits that. Oh, how the Left loves the Commence Clause when it suits their purpose.

So now that Paul is wrappered up considering mandatory evacuations and whether they are really enforceable (or for that matter, whether someone should be arrested for having a silly hairstyle), the bigger question is whether anything like this passes consitutional muster.
Dunno. There appears to be a fair amount of law concerning quarantine, but this current situation is not a quarantine, it’s sort of an anti-quarantine. Lock up well people so they don’t get sick.
No doubt people are cooking up challenges as we speaks, it’s an interesting corner case. Thank God the Trumps of the world try to install judges who care about the Constitution. If Obama had appointed more of his (desired) 17 Supreme Court justices, the law would consist of whatever they felt like that day. Our lives would be circumscribed by what a Justice had for breakfast that morning.

BTW, active shooter situations are a bad example. Those are local police actions. The State and Fed’s do show up post-event to help with the investigations. The evac of 200,000 people when it looked like the Oroville Dam was ready to give way was also a local LE action. Other agencies helped with traffic control.

To be fair, we should cut PaulEmery some slack. Paul should never play at a local bar or resturant again. Even when things open up, Paul is in an age bracket where his life is in danger if he ventures into his favorite watering holes, not to mention hanging out for a couple of hours to get on stage to lull people asleep.
It may not be fair. Call it age discrimination if you will. But, PE, like myself, are the ones most likely to die if and when the Wuhan Grim Reaper knocks at the front door. Sure, odds are that we will even survive when we catch the Plague, but it won’t be fun.
We may never defeat SARS 2.0 Chanel #5. Ever. Like water running down a hill into your backyard, it is much easier and most wise to channel the water away from the house rather than foolishly trying stopping it dead in its tracks.
Thus, let Paul grieve the lost of ever playing at the Lounge Lizard Sushi Bar and Grill again. It’s for his protection, not the normal patrons. If it saves just one Punchy, it’s worth it.
