18 USC SS641 relayes to THEFT of government property and materials. The record was not an official government document…if it were an official report on a meeting known as a 302 it would be a record. Regardless Comey gave the record to Mueller. According to court interpretation of USC 641 the statute relates to theft of an item of financial value….I guess Comey could have sold his recollection….but he didn’t he gave it away.

You can ask for anything to be reviewed for FOIA release, if you get what you want is another thing. You can also request a classification review and executive privilege counts as a classification, there are a number of classifications from mundane to eyes only compartmented.
Either way its an executive branch document that was transferred to a 3rd party with Comey admitting intending it to be transferred to the press. Comey also said clearly he knew he could not hand it off himself. 😉LikeLike

Any document generated by a federal employee belongs to the archive of the US and the agency. Your ignorance of the legal standing of notes of an FBI agent is understandable but its time to admit you are as wrong as you were about the fact of a document transfer.
Comey does not own it, the executive branch owns it, just like all of the docs in presidential libraries. He can not legally give it away.

Without reading one legal agrument on The Memos, seems to moi that all private conversations with the President and his underlings are classified by its very nature. That’s why you can’t get Obama’s phone conversations with Hillary during her silly private server chapter. Of course, a President can declassify anything he chooses.
Now, Comey was on the clock when he wrote the Feb. memo. Whether he did it on a gov’t server or took his notes home, it don’t matter. Those memos a property of the US Government, a very large bureaucracy headquartered in Washington DC. Ain’t his, it is property of Uncle Sam. Even notes stays with Uncle Sam. No to be removed. The timeline in question is when our long time public servant was on the clock.
I seem to recall a certain General and high ranking CIA chief sharing notes he took after conversations he had with top officials. Most of the no-no such as his personal notes a notes are classified and he had not right to share them with his secret squeeze box or anyone. They belonged to Big Bro, period. Sure, he also leaked other “classified documents”, but his notes were Exhibit A. What was his name? Oh yeah.

Bill, no conversations with the President are not automatically classified unless they contain classified information–they may be privileged but one would need to claim executive privilege and prove it. The legal standard is not that all government documents are government property–official documents and records are–nor is some one always “on the clock” And did you miss the identification of the materials as “classified” in the Petreus case?
Finally, do you realize how ridiculous you all look arguing over whether or not the memo was legally released, as opposed being appalled at the content of the memo, that the President of the United States is actively engaged in obstruction of justice, not just based on Comey’s testimony, but based on his own words when he said publicly that Comes was fired to stop the investigation?

In your original post you clearly conflated conversation with ‘privileged’ which it is not unless the President claims executive privilege; you used clearing the room as an indication of ‘privileged and confidential’ when in reality it was an egregious breach of protocol on communications between a President and the point person investigating his former NSA; you characterized as government property something that clearly according to the vast majority of legal scholars is not; you characterized that document as classified when it clearly is not and there is no indication that it is; you characterized release of that document as a ‘leak’ when it was not classified which all legal scholars agree is the definition of a ‘leak’; and you claim superior knowledge due to your previous status as a person holding a security clearance while completely misrepresenting the rules around the handling of the information.

Truckee is thriving. You know it, the readers here know it, the County knows it, and the numbers prove it. Almost all job and economic growth in the county has occurred in the last 15 years in the eastern County. As I stated earlier the reason for that is clear…we like each other and get along and our political culture is collaborative. I love the western county, and could not agree with you more that you have charming towns and landscapes, interesting people, and real amenities. It really is a shame that you can’t get your stuff together and leverage that for the economic growth and opportunity that it should and could be driving.LikeLike

Can you point me to one example of criminal action against any government employee of former employee? that matches the criteria for illegality that you ascribe to Comey and his so called leaks? George it is indeed your interpretation and an articulate one at that. I’m asking if there are real examples to illustrate your view of a very technical legal matter. We went through this with your view of health care. When i asked you for real examples you responded by saying it is only your opinion and there were none and it didn’t matter because it was just your opinion. . I’m wondering if this is a similar situation. A couple of examples that I could look at is all I’m asking for.
