I am trying to figure out how and why people would think that Comey cooked his own goose or harmed his position at all by ‘leaking’….he did not ‘leak,’ he relayed his experience in the conversation. Nothing in the conversation that Comes released was classified, it is entirely legal to talk about it, and he is a private citizen now, so he is violating no professional commitment.

Comey had the conversation with President Trump while he was a federal employee. The conversation was privileged and confidential between the two of them (recall Trump indicated that when he cleared the room), therefore the material Comey subsequently recorded was a confidential government record and government property. Its content could be declassified or made public at a later time, but it had not been so done when Comey leaked it. It matters not whether you are a private citizen or not when you disclose such classified information. Those of us who held security clearances most of our lives know this important little piece of law. Why did it escape Comey?

I am sorry there is nothing ‘privileged’ about a conversation between two government officials if no classified material is contained. Clearing a room does not make the information classified. There may be an expectation of confidentiality while someone is an employee, but if they leave the prohibition leaves. If that were not the case no one who left service in the White House would ver able to write a book 🙂
It is my understanding that the memo’s are in the possession of the Special Counsel. The memos have not been classified. Comey testimony did not include the documents as exhibits–he recalled their content from memory.
So in short–the information was not classified. As someone who held a security clearance for many years I assume you could tell the difference between a classified document and an embarrassing one.LikeLike

Greg, notes regarding an investigation would not be free to share…regardless in this case notes were not shared…recollections were… and there was no case, the President was not under investigation. One can only “leak” classified information. Comey went to great lengths not to put anything classified in the memo and not convey any recollection that could be considered classified.
According to media reports, Trump plans on filing a complaint with the Department of Justice next week based on Trump attorney Marc Kasowitz accusation of Comey, “unilaterally and surreptitiously” making “unauthorised disclosures to the press of privileged communications with the president”.
The problem is that the conversation was not privileged either. First they can’t claim privilege because they have already publicly waived it. Remember that? To claim privilege one would need o identify what the privilege is…as in executive privilege…and they did not do so.
No one has sited either any specific non-disclosure agreement (the FBI does not require one) nor has anyone quoted any specific FBI rule against recollecting a non classified event.
However, filing a claim with the DOJ could be considered witness intimidation…which I think could be a real issue here.LikeLike
