On this election day I remind you to vote, and am also reminded by all that is going on in a Washington that now sidesteps what I have voted for over the decades – the imperial presidency ascendant.

We just heard about EPA’s new initiative to cite a little-known, otherwise-purposed Section 111(d) of the 1970 Clean Air Act to begin the socialization of America’s energy industry.  Regulations initiating the banning of fossil fuels – beginning with coal – will “skyrocket” electricity and other energy prices in the land.  It is all done under the Big Lie of hindering climate change, which by EPA’s own accounting will serve to reduce temperatures by about 0.05 deg F in 100 years.  But this federal power grab will first hurt the poor, and eventually it will beggar the nation by increasing all costs and cutting jobs, thereby hurting all of us if a succeeding wiser administration does not roll back the damage.  In the interval we can always dream of a Congress that reclaims its pawned balls from the White House, and resumes its constitutional functions.  (more here)

Eric Holder’s DOJ is fulfilling its part in the imperial presidency.  Its latest assault on the Second Amendment is to include gun and ammo dealers as businesses subject to Operation Choke Point.  This little piece of sleaze was initiated for the salutary purpose of denying the nation’s financing and banking services to porn shops, drug paraphernalia outlets, escort services, …, and wouldn’t you know it, arms and ammo retailers.  The House is aware of this latest shortcut to autocracy, but in the interval the innocent will be punished, assuming that arms and ammo escape from Choke Point.  Contact your representatives.

Dems_FirstAmendMore on how the Left seeks to silence dissenting voices.  The asymmetric assault by the country’s collectivists on free speech has long been argued here.  The latest dollop of evidence comes from Senate Democrats who “have promised a bote this on a constitutional amendment to expressly repeal the free speech protections fo the First Amendment.”  Yes, 41 Democrats are co-sponsoring Tom Udall’s (D-NM) to give Congress the power to regulate ‘political speech’.  Their broad initiative is based on two propositions “money is not speech” and “corporations have no free speech rights”.  Both propositions are patently false and contradict not only US laws, but also seminal western cultural tenets that arguably over the centuries contributed much to the primacy of western civilization and all that it has and continues to contribute to the world.  In its slide toward autocracy, socialism cannot tolerate dissenting ideas, especially in the public forum.

An illuminating essay – ‘The Democratic Assault on the First Amendment’ – on this latest foray against the Constitution and liberty is penned by Sen Ted Cruz (R-TX), darling of the tea parties and nemesis of the Left.  Let’s see if our progressive friends will counter the salient points of the message instead of continuing to pillory the messenger.

Glad to see the Bergdahl repatriation case moved off center court to let discovery of the VA scandal resume its rightful place in the public eye.  Off course, the lamestream lackeys will continue to drag their journalistic feet on this, but continuing to poke what is turning out to be another foreign policy cowpie will only increase the smell and draw attention to the others on this administration’s resume.

The issue itself has several distinct (orthogonal) factors which Team Obama and the lamestream obfuscate for obvious reasons, but which outlets like Fox News and the more conservative blogs seem also to not distinguish.  Each of these must be addressed separately to decide the issue –

1. Given Bergdahl’s known sentiments about America and its role in Afghanistan, why was retained in a frontline combat unit?

2. Under what conditions did then Pfc Bergdahl walk away from his unit?  Basically, did he go outside the perimeter with or without authorization?  Statements from his comrades in arms who describe his departure indicate that he deserted.

3. No matter the nature of his departure, President Obama is lying when he characterizes Bergdahl’s captivity as having been “left behind” during ongoing combat.  At his departure his unit was on a stand down within a secured perimeter.  This markedly changes the nature of why and when we risk people, materiel, and mission.

4. What was the cost of searching for him in casualties and materiel, and where did authorization come from for the extra effort to suffer this cost?

5. Trading the Taliban’s strong suit of Gitmo prisoners for Bergdahl without the advice and consent of Congress, violating the law, and countermanding the administrations explicit promises to consult with Congress before releasing any Gitmo combatant prisoners is a legal matter in its own right.

6. Evaluating this ‘trade’ in concert with Obama’s long list of dubious/failed foreign policy initiatives confirms our early and subsequently verified assessments of this community organizer’s talents playing in the big league.  But this is a political matter which needs to be viewed in terms of how much support he receives from Democrats up for re-election.  We can count on the lying here to equal at least the level devoted to the Banghazi cover-up.

    Walt 1038am – I think that all RR readers are way too astute to have the likes of me tell them how to mark their ballots. All I try to do is reflect on how different kinds of politics, economics, cultures, genetics, and technologies affect society, our QoL, and the future of Man. And even then my interpretations and observations outrage a good fraction of those who frequent this blog. But then again, given what we see around us, that is how it should be.

    Love it. At least at my place of polling ( or “pole-ing”,, depending on how you look at these days) They have a nice way of checking who you are without the forbidden asking for picture ID. Aside from someone messing up personal info at the elections dept when entering it into “the system”, ( mistyped the Mrs. date of birth) things looked pretty good.
    Word has it, that whoever did the transposing of information from paper to digital, messed up plenty. Bad birth dates, street numbers, etc. The Mrs. was given a new voter registration to fill out and send in to “correct” their screw-up.

    Massive hail storm just hit Eastern Washington. Ice fall from sky, fruit trees damaged. Ice cubes the size of quarters fall upon villagers. Pavlov will mess up the computer models. The summer that never was is coming to a Quainty Town in the Great North Woods. Is it still outdoor hockey season?

    The Left seeks to silence dissenting voice? Say it ain’t so. You mean like their unconstitutional restrictions (per The Supreme Court of the United States of America)on political speech? Like, no mentioning an opponent 30 day prior to an election in ads? Like, a group can’t tie some Democrat Senator to their vote on Obamacare before an election? Seems silly when you think of it, does it not. “No group can mention my name, yet my name is on the ballot.” Oh, those silly self anointed protectors of the 1st Amendment are pooping their pants again.
    Ok, let’s connect the dots. The Distinguished Senator from The Great State of Nevada and also The Revered Senator Majority Leader has taken to floor of the Hallowed Chamber to attack the Koch Brothers day after day, week after week, month after month. Calling a private citizen out by name seems rather McCarthyism and I just dismissed it as Harry coming down with oldtimers or maybe caught some foot in mouth disease from our Revered Vice President of the United States of America.
    But the next dot goes directly to the Revered Minority Leader of The House of Representatives (Ms. Pelosi) who wants a Constitution Amendment of ban the whole concept that corporations are people too and have rights. Especially the right of free political speech. Guess if they are not considered individuals nor deemed personages with rights, then I suppose it would be most unfair from a non person to pay taxes, but I digress.
    This whole Constitutional Amendment thang has the entire left going batty. Strike that, they are going bongers, ape shit, looney tunes, rubber room time off the charts. I find it rather amusing. Very reminiscence of Linda Blair in the Exorcist with her head spinning like a top and heaving green vomit telling the Koch Brothers and the Christian Coalition and Karl Rove what exactly their mothers are doing right now in hell. I love this event way too much.

    Here’s a couple more lunies going on. A waiter at lumberjacks restaurant mentioned their corp is being sued for discrimination for having a “senior” dinner section on their menu.
    Contractor son says he has a lot of extra to do on the paperwork because the engineers who do the planning and architecture can’t put down specific measurements because they’re afraid of being sued if something goes wrong….so the entire liability is placed on the builder. Getting a little extreme?
    Word from a cousin who lives in San Jose. Rent is extremely high. Homeless people and crime are rampant. Entire families living on the streets. Heard San Francisco is having similar problems. Sorry to have to bring it up.

    Money buys speech (therefore it is spech) money is necessary for even a greenie like you to buy speech. Tell us all Ben Eery how you would get the word out to the Congressional District voters that they should vote for Ben Emery. I am curious.

    It’s up to the State Leg to act: Q. What are the political implications of GASB’s rules? Does this make the Legislature more or less inclined to adopt a funding solution for CalSTRS?
    A. GASB’s standards should not be used to sidetrack or misinform efforts to address key issues associated with adopting a solution to CalSTRS’ funding shortfall. Instead, the new rules offer an additional incentive to act.
    Prior to GASB’s new requirements, how governments funded pensions matched how they reported them in their financial statements. This relationship has changed, causing upheaval in financial reporting. Confusion between the numbers used to project a pension plan’s funding needs and those used in financial reporting further cloud the issue.
    What administrators should understand is that, outside of financial statements, the GASB standards may not provide relevant information to governments struggling with how to address unfunded pension liabilities. In fact, GASB has said that it does not intend for policymakers to use the new accounting requirements as part of the governmental budget process.
    Moreover, any attempt to restore CalSTRS long-term viability based on the GASB standards overly inflates the amount of contributions needed from members, school employers and the state, and could needlessly subject them to significant and unnecessary financial strain.
    However, if a funding plan were to be enacted by the Legislature, the magnitude of the liabilities reported in employer financial statements could significantly decrease.
    While GASB’s rules do not change CalSTRS funding status or what is needed to close the CalSTRS funding gap, they do serve as an impetus to take responsible action. For CalSTRS, what is needed to fund the existing benefit plan is an increase in contribution rates, which can be gradual and predictable. The state must act to adopt a responsible funding strategy.
    Q. What is CalSTRS doing to address its $71 billion unfunded liability?
    A. For nearly 10 years, CalSTRS has made considerable effort to call attention to its unfunded liability, which is the outstanding debt for projected future benefits, and the risk of not addressing it.
    It is important to note that contributions paid by CalSTRS members, employers and the state are sufficient to cover the ongoing costs of the benefit program absent a funding shortfall. But the impact of two major financial downturns less than 10 years apart, and the continuing failure of the state and employers to pay the annual amount required to eliminate the shortfall, has negatively affected the fund.
    Absent any changes in contribution rates or liabilities, current calculations show the fund will deplete its assets in little more than 30 years. The fiscally sound approach to sustain the long-term viability of the fund is a gradual, predictable increase in contribution rates, equitable to all parties.
    Unlike other California pension plans, the CalSTRS board lacks the authority to raise contribution rates to shore up any funding deficiencies – only the Legislature and the governor can do that. This is why the Legislature and governor must tackle the challenge of crafting a funding plan for CalSTRS.
    Q. Where can administrators go to get more information?
    A. CalSTRS has made information on GASB available on our website under the employers section http://www.calstrs.com/gasb-accounting-changes. On our site we have a presentation by our Chief Financial Officer Robin Madsen, who explains the impact of GASB Statement 67, “Financial Reporting for Pension Plans,” effective for CalSTRS this year, and Statement 68, “Accounting and Reporting for Pensions,” effective for plan employers in fiscal year 2014-15, to the Teachers’ Retirement Board.
    CalSTRS is in the process of reaching out to business officials to discuss the impact of the new GASB accounting rules.
