TechTest2014 examinees were feted at its annual Survivors’ Breakfast at Tofanelli’s this morning.  The pictured six top scorers – David Bernadett, Lars Montagnaro, Patric Wells, Grant Clove, Sean Anderson, Alex Vobiril – received their scholarship checks that ranged in amounts from $6,000 to $300.  Attending also were junior year students taking the test for practice, and an especially large contingent of parents.  All test takers told us of their current plans for STEM careers, and received their obligatory TT2014 t-shirts with leftovers going to parents and SESF staff.  SESF director Mike McDaniel again served as MC, and Executive Director Russ Steele distributed the filthy lucre to the well-deserving and grateful recipients.  (Go to sesfoundation.org to check out the test they so ably ‘survived’.)

VA healthcare illuminates the future of Obamacare.  The latest scandal has promised to be the yet smelliest of this administration’s scandals.  It has even scared Democrats who have remained scandal-proof to date.  But not all is well, the Big Government blinders are still firmly in place for our collectivist cadres who view this as just another minor aberration and growing pain that needs only a tweak here and there.  For them all programs are still running hot, true, and normal headed for a world in which criticizing the state will soon be a hate crime.  (more here)

‘Secrecy Cloaks Oil Trains’ reports the 23may14 WSJ.  The perverse policies banning the building of new oil/gas pipelines have required orders of magnitude increase in the number of large oil trains rumbling through towns and metropolitan areas across America.  For obvious political and security reasons the movement of these trains is kept secret.  This is scaring hell out of local fire departments and emergency first responders who have no idea when to increase their readiness for the exploding holocausts which such trains have already caused.  Big Government again demonstrates the evil outcomes of its policies given birth through corruption and/or ineptitude.  (more here)

The increasing pain that afflicts America is felt in thousands of small communities across the land, communities filled with people who still try to work for a living, and those who remember what the country was like not so long ago.  Here’s a typical cri de coeur from a small Michigan town on the shore of Lake Huron.

TawasCityNevada County’s ‘invisible’ barriers to commerce and property lifted their head higher than usual in the latest of expensive lawsuits in which the county is the defendant through ineptitude and corruption denied.  Invisible? By that I mean invisible to our bigger government loving progressive neighbors.  The law suit involves the building of a cell phone tower on a Lake Wildwood ridgeline the permit for which continues to be “improperly denied” according the court.  Reported in the 23may14 Union (here), this is just a small stanza in the county’s Lyric of the Litigious Left that affects all residents.  As a productive alternative, the county could fund a full court press in bringing wide area broadband to the region for a fraction of the cost that it is paying for defense lawyers.

[update]  While hundreds of thousands of central valley acres parch and orchards are dying, the government is releasing massive ‘pulse flows’ of fresh water from California reservoirs into the Pacific Ocean so fish can have a proper water temperature as they swim to the ocean.  This is beyond butt stupid (I would even call it criminal) policy and enthusiastically implemented by the country’s environmental know-nothings with the full backing of the government gun.  Congressman Tom McClintock explains the matter in a piece titled ‘California Drains Reservoirs in the Middle of a Drought’ appearing in the 24may14 WSJ.  And progressives have no idea why we think big government is necessarily evil, and bigger government even more so.

[30may14 update]  Years ago I should have started an ‘I told you so’ category.  Socialist French President Hollande’s current plan to roll back France’s income tax rates in order to increase government revenues would be a prime contender in that category.  Candidate Hollande, in typical populist fashion, promised to his country’s sheeple to soak those filthy rich of their excess cash by raising the top tax rate to 75% for all earnings above €1M.  The budget analysts dutifully projected the appropriate revenue increases into their treasury, and everyone sat back to wait for the new monies to start pouring in (because as every collectivist knows, income tax rates don’t affect the propensity to earn income).  Bummer!  Revenues fell by one third in the affected categories, and foreign investments plunged by almost 80%.  After quickly wiping egg off his face, Hollande is now rolling back taxes, and with great relief is watching revenues start to go back up again – ‘Now what did I do with that damn Laffer curve?’  I will wager that the sumbich hasn’t learned anything from this, and will start raising taxes one mo’ time when France’s next financial tit gets in a wringer.  For socialists it was ever thus – look no further than right here in California.

    Just a clarification, the suit the County lost this week was the one with the Lockyer’s over the conditions imposed for their building permit:
    “The second suit, the subject of the current Nevada County Superior Court ruling, involves the county’s treatment of the Lockyers’ subsequent permit application to build a home with a garage and office building on the ridgeline on their land, nearby to the proposed cell tower site.”
    This suit could have been avoided had the County at the request of the Supervisor Hank Weston, weighed in when the Lockyer’s requested help resolving the issue. It was not under litigation at the time they requested help, and could have been death with separately since it was a separate action. By failing to weigh in to provide assistance Supervisor Weston open the County up to potentially costly damages.

    That should read ‘dealt with’.
    This is a classic example of where investment in an ombudsman could have saved the County a ton of money. Mr. Weston was clearly confused when he told the Lockyer’s that he could not weigh in due to litigation. He was confusing this case with the other two.
    Simple but costly error.

    stevenfrisch 300pm – Agreed; good clarification. Also think that having an assigned ombudsman who know the ropes to guide a permit applicant through the maze is a good idea. It almost sounds like a consulting biz opportunity for someone studied up on the process, or a retiree from the planning department. But then there’s the possibility for abuse – oh well.

    One of the regulatory impediments that Michael Anderson fails to recognizes are restricting the use of ridge tops for the deployment of broadband antennas. One of the big challenges in deploying broadband in Nevada County are tall trees, ridges and vallies. Trees, especially wet trees block the broadband radio signals. One of the way to meet the challenge is to put a small antenna, about the size of a pie plate, above the tree tops. This allows the wireless Internet service provides to establish a line-of-sight from the elevated antenna to the clients facility, business or home. However County regulation do not allow any visual object above the tree line on a ridge. Even a small pie plate sized antenna that is critical to bringing universal broadband to Nevada County.

    I do think that we should be concerned though that a citizen had a significant permitting problem, went to their County Supervisor to seek help to resolve the issue, the County Supervisor confused the permitting issue with another case and refused to assist, the property owner sued the County, a court agreed with the property owner that the action of the County was a regulatory takings of private property rights, and the mistake potentially could cost the County hundreds of thousands of dollars in legal fees and penalties.
    Let’s hope the issue can be resolved short of that cost being born by the taxpayer, but the chances of that seem slim. The property owner has amassed significant legal fees and we all know lawyers have to be paid. The only thing that could make the situation worse for the taxpayers would be an appeal that the County loses.
    I also think that considering the emphasis many here place on property rights issues in general, and against regulatory takings specifically, that this issue would be of great interest to the readers here.
    Why aren’t the Lockyer’s Nevada County’s Cliven Bundy? After all this was an ACTUAL regulatory takings instead of a pretend one.
    What responsibility does Hank Weston bear for allowing this to happen on his watch?

    In my travels, it seems our local “biz” council folks have fell asleep at the switch.
    Getting local products put on non local shelves should be a priority.
    Not a bottle of Nevada County wine can be had on the islands. What gives?
    Someone needs to get busy and get those quality products on the approved
    shipment list. Plenty of Napa squeezin’s and other Ca. booze.
    Rubbed some elbows with knowledgeable high pollut’n folks who knew of
    this aria,, and was asked, ” Just what the hell went South in GV/NC?”
    They spoke of GVG of days gone by. I had to tell them the truth. GV/NC
    has become Berkeley of the foothills. Regulations rule supreme, and the dream is for total reliance on tourism. The same people enquired about “the mine” being reopened. Of course I got them up to speed on that.
    Yes, Nev. Co. seems to be well known, but not much of it good.
    Now “someone” get off their keester and get what “good stuff” we DO have
    on the export lists.

    The permitting process is an ongoing issue in this state. All govt officials seem to think that it’s his or her job to make sure the A priori answer is no. Then it’s the applicants job to try to spend themselves into bankruptcy to prove otherwise. Our family and my wife and I can attest to this county’s ability to make sure that every single constituent involved will lose. That includes the tree huggers. In one case they made sure that the existing natural environment, the taxpayers, the govt, the developers and our family all lost significant sums of money and/or protection from future bad development. It was lose lose lose lose. And we get to fund this bunch of idiots. Another point of complete stupidity of this county. We live on a county owned and maintained road. Our road is a death trap if a fire breaks out around here. There are places 2 cars (let alone rescue or fire trucks) can not pass. We had the county road engineer out to discuss widening and paving the road. Our family and some neighbors were willing to pay for the paving. Property values go up – road is fire safe – and maintenance costs go down. Win, win, win. Nosiree bob. Trees (all on county right of way) would have to be cut down. The county engineer declared that the property owners would have to give them permission to do that. Couldn’t possibly do that. So we live on a road that wouldn’t even pass the county’s idea of what a drive way should be. But it’s the govt and the govt does whatever they want. And they go on and on about fire safety. I wouldn’t blame the fire crews for not even wanting to go down our road. Once again – everyone loses. And we get to pay for it. I can go to Reno and lose and not be billed every year for overhead. If this were the 1700’s we would be out shooting people dead, and we would be called patriots. Now we just sigh and pay our ever increasing tax bills and illegal fees. And we are still called names. Whatever.

    Scott. One other thing on the fire-front you speak of, is just what our local departments are buying for fire trucks. PV has been buying the biggest and widest they can find it seems. The latest is more suited for city use. Just getting it down my own dirt road, let alone out is a challenge. ( “Last sunset” acres gets routine visits) Not the brightest buy in my opinion. ” Flatland” fire rigs have no business being up in these here hills.

    You should see the propane truck crawling along our county road. Barely fits through some spots. I just find it comical that we have these rigidly enforced standards for drive ways when the ‘enforcers’ don’t even keep their own roads to any standards at all. Govts now exist primarily for their good. Just shut up and pay, sucker. Laws are merely something I have to obey, not the govt. It’s out of control and I don’t see enough citizens worthy of the name pushing back. If you do – even peaceably, you are suspect. We have, collectively, the govt we deserve.

    Fish, SBC is in cahoots with land trusts and those scams are a legal way to “take”. We all know SteveF is exhibiting phony concern. But like all lib fools he is transparent. I think I read in the Union that those people contributed a tidy sum to Fran Cole in her bid to oust Hank Weston. I too wonder why SF is not on board the Bundy wagon since he is now so concerned about takings. Too funny.

    You are right Todd, I have done a number of land deals, or worked with people doing them. More than 100,000 acres worth, and damn proud of each of them. And never have I worked with an unwilling seller, or had to deal with the takings issue, because I did it with competent legal help, and appropriate oversight.
    And of course I am interested in takings, I have studied it for many years now.
    My concern is that unlike the Bundy case, where Mr. Bundy grazed on federal land knowing lease payments were due, in this case the County included an exaction that was not appropriately legally vetted, at great cost to the taxpayer.
    “In March 2012 the property owners wrote him a letter expressing their disappointment about what they characterized as bullying, violation of their constitutional rights, evidence of false statements, improper decision making and illegal conduct. Supervisor Weston responded in writing to them that he could not comment on active litigation. While he is correct that Supervisors should not comment on ongoing litigation, he was uninformed, as there was yet no ongoing litigation relating to the facts in dispute here. He was confusing this matter with other pending litigation resulting from Verizon’s actions in trying to place a cell tower in the vicinity.”

    Again Steve….and I know that this will deeply offend your inner policy wonk….outrage surrounding the Bundy affair had everything to do with the response and next to nothing with the fundamental issue.

    First, remember, my advice was to starve the ornery old bastard Cliven Bundy out. I am the one who did not want to precipitate a Waco and suggested the best course was to back off, lien his property, block his water and power, seize his bank accounts, isolate him financially, and make it impossible for him to pass his property on to his family until he paid his fees.
    After all, this has gone on for 20 years and he should be dead in the next 10 anyway.
    But lets be clear, Bundy fought his case in court from 1998 to 2012 and lost. His claims of inherited grazing rights have been widely disclaimed. His case for states rights have even been rejected by the State of Nevada whom he claimed them for. Even the local Sheriff is on record now as saying that the armed opposition must face responsibility for their actions. The Bundy case was adjudicated by a federal district court judge who is a fellow Mormon and Reagan appointee.
    The response in the Bundy case was no different than it would have been for anyone else: law enforcement showed up to seize his property to pay fines he was adjudicated to owe. It was his family, friends, and assorted criminal elements that escalated the incident.
    By the way, have you noticed that the Clark County Sheriff’s Office and the Federal Bureau of Investigation are now investigating the incident in preparation for issuing warrants for the arrest of those who brandished weapons at federal law enforcement?
    It was the crazy mofo’s that visited our community under the auspices of the our own home grown local conservative groups who were showing up with the guns and militia members covered in neo-Nazi tattoos and said, Hey, lets throw the women and children in the front line, that way when the Feds open fire it will play better in the media.
    The facts in this case in Nevada County appear to be pretty clear; a property owner, concerned about their property rights, requested help from their County Supervisor and the County Supervisor refused that help because he was confused or did not care to get involved.
    That same County Supervisor is endorsed by the Nevada County Republican Central Committee for reelection to the office.
    What responsibility do the property rights activists who speak up here have to rebuke that endorsement?
    The issue at hand is the hypocrisy of our local property rights advocates not the incident in Mesquite, NV.

    Good point, Mr. Fish. It was the response to Bundy that is now SOP (standard operating procedure) in this post racial America. Hard to defend Bundy on the merits of the case, but we all love David vs Goliath stories….er…, I do for certain….don’t know about the rest of ya’ll. From Bundy’s POV (point of view to the non hip, slick, and cool), Bundy was facing a 90% reduction in grazing land, which would have put him in OOB (out of business), again for the non hip, slick, and cool.
    Now, to a little line in Dr. Rebane’s post that is so very true and scary. Fact is stranger than fiction:

    Oh my, I could write volumes on this, but I will spare the dear readers and other haters out there. Just look at Joe the Plumber as a minor tiny example. He is in his own yard when Obama passes by and approaches Joe. Joe asks a question and all hell breaks loose. His tax records are released, he is called a Republican right winger conspiring to attack Candidate Obama cause of his Negro blood and planted there in his own yard by evil doers.
    Its got a lot worse since them days. I don’t mind if I say the wrong thing and the SS (Secret Service or SS) shows up at my door. That I deserve. But, I do mind the living hell of the IRS gleefully giving a weekly, monthly, semi-annual colonoscopy for criticizing the state. Or, like they do in Chicago, have my power “accidentally” shut off at various times.

    What do you think of Mr. Weston’s responsibility for the risk he appears to have put the County in, and the ruling that the County violated the property rights of the Lockyer/Erickson’s?
    Why are you supporting a candidate who a court has determined violated the property rights of a constituent?

    You do not, (SBC) pay any taxes to the government on the “millions” that go through your books. You deny the poor, the women, the middle class and yes, the property owners and schools the money needed to run them. You have not one iota of credibility here and elsewhere when it comes to property rights. You organization teams up with other “Land Trusts” to rob the county and State of even more taxes. Land Trusts are a scam perpetrated on the rest of us who pay to run the government and pave the roads and the police.

    ” Trail busting” is a good term to use. ” Public” trails by right of easement got written out of the deeds.
    We had a good fight over that right here. But since it’s a rich LIB, we know how that will go.
    I say welcome to the big leagues trail users,, now they get a taste of what the OHV people got.
    As for Mr. Bundy,, ” Prescriptive use” laws apply. Need a reminder Steve? ” NID ditch/trail” users used “prescriptive easement” laws to win that battle.
    Then some clown buys a land locked parcel of land, and tries to use some long abandoned wagon road to claim “right of access”. At least smarter heads prevailed on that one.
    As for Weston,, at least he isn’t Izzy Martin,, or Vanzant,,,

    I want to know how you can excoriate Bundy and praise and love Rosa Parks for the very same thing. How do you get away with funneling millions of dollars thru your non profit sans taxes and then complain that Bundy supposedly owes taxes? Inquiring minds want to know.
    Regarding Weston. The provisions those folks were being held to by the General Plan regarding ridgelines was placed into the General Plan by Izzy Marin and her friends. You cannot give them a pass as the instigators of the laws and then whine when they are implemented by Hank. I fought those provisdion when I ran CABPRO but you and your pals won the day Frisch. Why the change now?

    The question is what responsibility did Mr. Weston have to respond to the request and avoid a takings? Why didn’t he step in and try to resolve the problem? I think the answer is pretty clear but I want to hear you say it: either he confused the cases costing the County hundreds of thousands of dollars, or he did not care enough to step in costing the County hundreds of thousands of dollars.
    You can dissemble all you want about how we got here but you can’t answer the question can you?

    By the way, I don’t know Oprah; Bundy never claimed prescriptive rights in court; my employment has nothing to do with the case and has the same right to non-profit status your church does; and it doesn’t matter who created the law when asking why an elected official did not step in to help resolve the issue.
    Your guy turned a blind eye to these people property rights issue, and allowed the County to engage in a regulatory takings, and you are still supporting him?

    Oil Trains and Pipelines:
    In reference to the XL Pipeline. The head of the Canada Pipeline Company was on Fox News this morning and he said that production has already exceed the capacity of the XL Pipeline and they are planning a pipeline to the East where they do not have to deal with the US government. This new pipeline can satisfy the oil needs of Eastern Canada, which now imports fossil fuels from the US, and put the oil in tankers to ship it around the world, and even to the US if we were willing to buy some. He anticipates that between Canada’s Oil Sands and the North Dakota oil fields the production will soon exceed the capacity of the XL Pipe Line by 2.5X. Until the pipeline East is built, that extra production is going to be shipped by rail cars. It was his view that commerce will always find a way around the regulator and political road blocks, thus the Eastern pipeline is born of necessity, no US involvement. It appears that the XL pipeline could be build to just South Dakota and skip Canada if they build the Eastern Pipeline to the Sea. He made it very clear, the oil is not going to stay in the ground, so Obama’s delay of XL is only a hollow symbol for his environmental wacko friends.

    The feasible intervention scenario Handley presents could even have been done one better. When a situation like the Benghazi attack arises, you send help even if the help doesn’t have fuel to return to base and, say, must ditch over the Mediterranean. I vouch that given that potential alternative, the entire squadron of F-16 pilots at Aviano would have stepped forward to volunteer for such mission.
    Most certainly the absolutely ludicrous statement (by Panetta?) that we don’t commit our forces to go into harm’s way until we fully understand the situation is blatant bullshit. Our armed forces and even our police have always been committed into such situations before they are “fully understood” – that is what their job calls for, and that is why they are the heroes who deserve our support, admiration, and even homage.

    Walt 1007am – your “how much government …” question will most likely never be answered. Why? Because that would require revelation of an explicit progressive tenet, and that is harder to pry out than finding hens’ teeth. No progressive, or even middle roader, wants to express belief tenets which later could be called into question. It is much safer to just assume the high ground from which to issue ad hoc criticisms of how others act on their beliefs. Here again, we note that these folks don’t dare take to task one of your expressed belief tenets, which exercise might reveal one of their own. They just erect a suitable strawman out of whole cloth (to mix metaphors), and joyously launch a successful attack against that while attributing the loss to you. Done right, the nebbishes standing in awe on the sidelines will never realize what just went down.

    Walt, how much government? Lets see now. In the days of yesteryear and the meat and spuds of folk legends of yonder times, the best government was one which governed least.
    I read Thomas Jefferson’s Second State of the Union Address (maybe his first), and it was quite telling. He said we have this much money in the vault, the savages were still causing headaches, the War with the pirates over in Tripoli wasn’t going great and another warship would be needed according to Navy Commander So and So, and….drum roll please…..and the money received from tariffs was enough to pay the bills so a precious tax would be rescinded and no taxes necessary. Truly a real State of the Union down to the nuts and bolts.
    So, how much government is needed in The New Millennium?

    The facts in this case in Nevada County appear to be pretty clear; a property owner, concerned about their property rights, requested help from their County Supervisor and the County Supervisor refused that help because he was confused or did not care to get involved.
    That same County Supervisor is endorsed by the Nevada County Republican Central Committee for reelection to the office.
    What responsibility do the property rights activists who speak up here have to rebuke that endorsement?

    Russ, I have been a member of both the Gold Country Broadband Consortium and the Nevada County Broadband Advisory Group since 2012, when both were formed. In the first meetings, I was one of the members who thought we should focus our efforts on removing regulatory obstacles such as those you wrote about, as well as requiring vendor-neutral conduits for all new developments. In fact, I tasked myself with writing a Nevada County Broadband Plan that we would bring to the NC board of supes for ratification. The focus changed when SEDCorp changed leaders, as you well know.
    You future of broadband in Nevada County is fiber, not fixed wireless. Fixed wireless will always have an important role, but it is not the key to our county’s economic development.
