In this heated election season this little piece of correspondence I received might come across as a bit of administrivia.  But since it involves a local elected official – Clerk-Recorder Gregory Diaz – it may be worth a look in passing given his performance on the recent disastrous AtPac suit (q.v.).  It seems that Mr Diaz was not following federal law on how military service members’ and overseas voters' absentee ballots were handled.  He was notified of this, and even got a federal grant of $77,000 to fix the problem.

Well he didn’t, and the federal government sued California in which Nevada County was named as a non-compliant county.   The resulting judgment requires higher ups to keep an eye peeled on how we handle military absentee ballots in the future.  You can read all this yourself.

    Speaking of absentee ballots, we know someone who received two ballots for the past June Primary. One absentee ballot received at their PO Box and the other at their residence mailbox. Makes me wonder how often that happened in Nevada County in Primary and other elections in the past. Wouldn’t take much to count both depending on an anticipated outcome on election night.
    The federal lawsuit is of special concern especially AFTER having received the $77,000 grant to fix the problem.
    Where’s the Nevada County Grand Jury on this???

    Odd that this information first appeared in a headline on the Barry Pruett blog on “NCVoices” earlier this afternoon. But when I clicked on the story to read it, a blank page came up. Why was this story removed without explanation, but then appeared here instead. I also noticed that this matter was resolved in May, yet it is being posted here now. Strange timing to discuss it (the night of Obama’s speech). Also no comment from the Clerk-Recorders office, either, not to mention the positive Grand Jury report about how the Clerk-Recorder’s office is conducting matters.
    Last I found the comment “in case you wonder whether this post is racist” needlessly defensive. Now “ax grinding,” that’s another matter. LOL!

    MichaelA 617pm – an excellent point Michael. Could you please let us know how you came upon “this matter” as “old news”. I don’t recall seeing it in the paper, and I searched the Union for any indication of this under ‘Greg Diaz’, and received a lot of hits relating to him dating back to last September. However,there was no news of the initial citation of the county’s irregularity, nor of any resolution of it. So it was news to me, and I thought it might be news to other readers. Please disabuse us.
