My sources tell me that – “On December 9, 2010, Magistrate Kimberly Mueller ordered Nevada County to reimburse AtPac for fees incurred in the amount of $20,250 for failing to produce documents as required by law. Magistrate Mueller found that AtPac was diligent in its attempts to obtain the documents, but that Nevada County failed to produce the documents without justification. It is noteworthy to point out that Magistrate Mueller specialized in intellectual property prior to appointment as a federal magistrate.”

Readers may remember the law suit brought against County Clerk-Recorder Greg Diaz and Nevada County in the matter of some alleged illegitimate transfer of intellectual property (software) by Mr Diaz.  The Union covered part of the story here.

When I called the county counsel’s office to confirm what should be a matter of public record, I was told that such issues would be referred to outside counsel that county has retained to handle this suit.  After asking for the outside counsel’s contact information, I was directed to a Ms Caroline Mankey in the 424 area code.

When I called Ms Mankey, she confirmed that such an order had indeed been issued, and that it was a matter of public record.  Nevertheless, she stated that she was not yet “at liberty to comment” further on the matter.  She and her colleague, lead counsel Mr Nabil Abu-Assal, would have to confer with their client before anything further could be released.  She asked that I call her back tomorrow for any additional information that might be available then.  I will do that.

At this time I will not speculate why the county and Mr Diaz, both claiming innocence in the matter, did not release documents that could well torpedo the remainder of AtPac’s suit, and instead are prepared to reimburse the plaintiff from county coffers as a penalty of their non-cooperation.

(For the record, I was asked by both offices who I was and whom I represented.  I responded that I was a private citizen representing no one but the audiences of my modest trumpets.)

[15dec2010 update]  This morning I called Ms Mankey as she advised me yesterday.  The receptionist dutifully took my name and the nature of my call.  After a short delay I was informed that Ms Mankey “was not answering her phone.”  I left my name and phone number with the request that she return my call.  In the interval further corroboration of the above reported action by Magistrate Judge Kimberley Mueller arrived by email.  It seems that Nevada County formally asked for “reconsideration of the Magistrate Judqe's November 78, 2010, Order (Docket No. 56) regarding requests for production of documents and admission.”  This request was denied yesterday and the order to produce the required documents still stands (pdf of court order Download AtPac Order 2).

Perhaps all this is not newsworthy.  Neither The Union nor Yubanet.com has yet to devote any real estate to its coverage.  Nevertheless, working in the back rows of this vineyard, we await Ms Mankey’s call.

[21dec2010 update]  Well, maybe it's newsworthy after all.  For the record, I sent Jeff Ackerman an FYI on the original post.  Did not get a response.  But this morning's Union featured this story on its front page (here).  Apparently both RR and The Union are being stonewalled by the county's attorneys on the matter; neither of us have yet to get a call back from Ms Mankey.  Going on no more information than this, it sure is beginning to look like either fog or smoke coming out of the Rood Center.

    Customarily, courts will sanction parties that fail to disclose documents (in this case Nevada County and Diaz) by forcing them to pay the legal fees of the the other party. Sanctions are rare and only ordered by a judge in the most egregious circumstances.

    The County network is state of the art, with sophisticated back up systems. How come the County IT team could not find the requested electronic documents? Unless those documents are the smoking gun as to had access to the intellectual property in question and when, and the County does not want the access records found. This is getting to be a real mess and could really damage the reputation of our local county government. I suggest they do a little risk assessment and come clean real soon now.

    While Pelline is apoplectic over IMM, the silence in connection with his guy (Diaz) is deafening. I am sure that he waiting to get some talking points from Diaz.
    Last week, the county and Diaz requested the federal judge to reconsider the magistrate’s order. Yesterday, the judge denied the request.

    I believe The Union will eventually get to it, then the story will have legs. I learned the hard way that county government pretty much does what it pleases. After all, it’s only money.

    The plot thickens hehe – what could Jeffy have been so mad about? reads like a news story
    When I read about this from the beginning it sounded from a laymans perspective the county was guilty, that does not always mean anything in the world of law. Sounds like like they got an excellent judge for this case though. As Russ pointed out and the salaries that I saw awhile back this place shouldn’t have piles of papers stored in cardboard boxs someplace.

    Here’s another tip for your “gumshoe” reporting: Go back to the last BOS meeting, and you’ll see some mention of this case.
    BTW, speaking of “censorship,” why is there no reporting from this group about the documents alleging voter intimidation in Truckee? Double standard?
    In fact, Barry, those poll watchers who were accused of the intimidation and disruption up there weren’t “retired old ladies” as you said after all, were they? LOL forever on that one!

    I know you’re not the sharpest tool in the shed but follow me S-L-O-W-L-Y:
    The extreme right blogs — Barry and Russ — jumped down the county’s throat, making fun of the Other Voices column about voter intimidation. Barry wrote that the county was whining about “retired ladies.” Russ was also insulting.
    Only as it turns out, when more documents were released, the poll watchers who were accused of intimidation and disruption weren’t “retired ladies” at all — they were much younger people involved with the McClintock campaign. Barry to fill you in on more details over your “pina colotas.” (Your spelling).
    No follow up, though, from the extreme right blogs. The silence was deafening. LOL.

The ‘image to ASCII’ algorithm in Adobe Professional interpreted the date as ‘November 78, 20L0’. I caught the L part but missed the 7. For certain readers this omission provides untold entertainment as witnessed here.)
    Jeff, thank you again for the signature way that you were able to point out this correction. And I also appreciate the “gumshoe reporting” tips. Am not sure whether these derive from your arms-length journalistic studies, or from current practice.
    From a careful perusal of your contributions Jeff, do you really want to be a commenter on RR?

    Yes, please do not go down Pelline’s bunny trail. Let’s focus, we know about the 20K in fees, but what is the independent council going to cost the County? This is going to be huge $$$ sink hole before it is all over, unless the BOS realize they were bamboozled into supporting Diaz and cut their losses. Stay Tuned.

    When Green won the Assessor post in 1998 he was caught paying a contractor a million bucks to do software which never came to pass. After GJ investigation it was revealed Green was paying people who owed him money and this crook was using our tax money to get paid back. I had actually given the info to Seelmeyer way before the election who chose to ignore it. After six months Green resigned under threat of prosecution.

    I had a long and stormy relationship with him. He ran articles made from whole cloth about me and people I debated and he was not her. He, like other liberals, did not like conservatives. He used the excuse it was political drama but he had the info from others besides me. He was also a buddy of Greens.

    speaking of further embarrasment – wasn’t it you that as recently as last week were still gloating over Mr Diaz beating Barry in an election. You even were saying the entire lawsuit was BS if I remember and then used the fact that Barry had been associated with the plaintiff as some derogitory pretense to vote against him in the election. After 2 botched elections and what appears to be a very diabolical and very expensive sequence of events unfoldeding here you sir look most like a large cow pie – just say’in

    Any word from Mankey?
    I did some research about the magistrate.
    Judge Kimberly J. Mueller is currently a United States Magistrate Judge for the Eastern District of California, a position she has held since 2003.
    On March 10, 2010, Magistrate Mueller was nominated by President Obama to sit on the bench as a judge of the Eastern District of California.
    “I am honored to put forward these highly qualified candidates for the federal bench,” President Obama said. “They will be distinguished public servants and valuable additions to the United States District Court.”
    Previously, Magistrate Mueller was in private practice specializing in intellectual property work, first as an associate attorney with Orrick, Herrington & Sutcliffe LLP and then as a sole practitioner in Sacramento. Judge Mueller has taught as an adjunct faculty member at Pacific McGeorge School of Law and at the U.C. Davis School of Law. Prior to earning her J.D. from Stanford Law School in 1995, Mueller served a five-year term on the Sacramento City Council and was Health and Safety Director of the California Firefighter Foundation.
    Seems pretty knowledgeable about the type of law involved in the case.

    They are still fighting. The County and Diaz provided some of the records but not all as required by the court order. Another ruling should be coming from the magistrate in the near future.
